What Is Florida’s New Super Speeder Law?

Excessive speeding has always been dangerous. It's a factor in thousands of serious and fatal car accidents in Florida every year. However, in Florida, it’s now a lot more serious legally. As of July 1, 2025, Florida’s new “Super Speeder” law is officially in effect. For anyone driving in or around Tavares, The Villages, Inverness, Clermont, or elsewhere in the state, this law could result in steep penalties for driving significantly above posted speed limits.

Florida experienced more than 16,000 speeding crashes in 2023. This includes 169 deaths and thousands of serious injuries.

The goal of the new law is clear: to discourage the kind of reckless, high-speed driving that has become increasingly common on Florida highways. With hundreds of drivers cited for going over 100 mph in a single year in Orange County alone, the legislature and law enforcement agencies are treating this as more than just a traffic issue; it’s a public safety concern.

What the Super Speeder Law Does

Florida’s Super Speeder law targets drivers who exceed either of the following thresholds:

  • Driving more than 50 miles per hour over the posted speed limit
  • Driving faster than 100 miles per hour, regardless of the posted limit

Either offense could lead to hefty fines, jail time, or both. For first-time offenders, that could mean up to 30 days in jail or a $500 fine. Repeat offenders face up to 90 days in jail and fines of $1,000. If someone is convicted of a second offense within five years, they may lose their driver’s license for a full year.

The penalties are serious, which they should be. Because when someone drives 100 mph or faster, they’re not just breaking the law, they’re putting lives at risk.

Why This Law Matters for Injury Victims

Reckless speeding isn’t a rare occurrence in Florida. According to the Orange County Sheriff’s Office, deputies cited more than 500 drivers in 2024 for going over 100 mph. That’s more than one reckless driver caught speeding every single day.

Speed is one of the leading causes of serious and fatal car accidents in Florida. High-speed crashes often leave victims with catastrophic injuries that affect every aspect of their lives, from permanent disability to mounting medical bills and lost income.

This new law gives injury victims more support when proving that a driver’s behavior was not just negligent, but grossly reckless. It provides a clearer threshold for what counts as extreme speeding. That means if someone was traveling at 100+ mph and caused a crash, there’s now a stronger legal basis to demonstrate the driver’s recklessness, which helps victims pursue maximum compensation.

Officials say many of these super speeders also engage in aggressive, high-risk behaviors, including:

  • Weaving through traffic
  • Tailgating at high speeds
  • Cutting across lanes without signaling
  • Driving under the influence

These behaviors drastically increase the risk of a crash. And when someone is hit at high speeds, the chance of survival drops dramatically.

As Sheriff John Mina stated, “When you are going over 100 miles an hour and you get into a crash, you’re not going to survive that, and neither is anyone you hit.”

How the Law Helps Personal Injury Cases

In the aftermath of a serious car accident, injured victims often face an uphill battle. Insurance companies may dispute the severity of the crash, blame others, or try to minimize compensation.

That’s where the Super Speeder law can make a difference. It strengthens an injured victim’s case by clearly labeling certain driving behavior as extreme and dangerous. When a driver is found to have violated this law, it becomes easier to prove:

  • They acted with reckless disregard for others’ safety
  • They caused the crash due to egregious speeding
  • They should be held fully liable for the harm they caused

A personal injury lawyer can use a Super Speeder citation or arrest as strong evidence to support claims for medical expenses, lost wages, pain and suffering, and long-term damages.
