Waitress dies in Keys collision

A 22-year-old woman was killed and a 24-year-old man was injured in the Florida Keys after they were involved in a head-on car accident with a taxi on May 13. The pair had traveled to Islamorada for an annual end-of-season party for South Florida service-industry workers. Authorities suspect that both victims were drinking and it appears that neither was wearing a seatbelt.

Authorities report that the 24-year-old victim was airlifted to the Ryder Trauma Center in Miami-Dade, while the 71-year-old driver of the taxi was taken to Mariners Hospital. The older man remains in serious condition. The female victim was also transported to Ryder but she died shortly after the collision.

Victim's mom files suit against city in car crash incident

The mother of a young South Florida woman who was killed during a collision with a police officer is seeking civil damages for wrongful death. The 21-year-old victim died several days after the vehicle in which she was riding collided with a police cruiser on October 19, 2012.

Official police reports show the civilian driver, the woman's boyfriend, was to blame for the accident. Attorneys for the victims, however, claim to have tapes that show the officer driving irresponsibly while traveling to a non-emergency call. The officer allegedly travels at a high rate of speed in a 40mph zone, sometimes reaching speeds of 80 mph. The officer is also accused of ignoring a red light.

Workers reach settlement in collapsed garage tragedy

You may remember our blog reporting about the collapse of a South Florida parking garage that injured or killed a total of nine construction workers. The wrongful death civil suit in that case has concluded, with relatives of the four deceased workers receiving settlements in connection with the case. The five injured workers also benefitted from the financial compensation offered by defendants, Ajax Building Corp., and several other subcontractors. The terms of the settlement are confidential.

Authorities report that the concrete garage at Miami-Dade College's west campus collapsed on the workers during October 2012. The accident was so severe that one worker's body could not be recovered for a full week; the debris pile was too unstable for recovery teams to enter. The collapse of the five-story, $20 million garage had wide-reaching impacts, forcing the 8,000 students at the campus to attend classes at other locations until after the new year.

Motorcycle crashes on the rise

New numbers from the Florida Department of Transportation show that the number of motorcycle crashes has increased by about 15 percent since statistics were last collected. An analysis of 2011 crash numbers revealed that 8,621 people were involved in motorcycle collisions during that year, demonstrating a marked increase over the previous 12-month period. This trend, a continuation of a decades-long increase in the number of motorcycle injuries and deaths, is troubling to local officials.

Researchers report that motorcycle registration in the state has more than doubled since 2000. Additionally, a new law that year allowed motorcycle riders over the age of 21 to ride without a helmet as long as they were covered by a minimum $10,000 insurance policy. These and other factors have combined to make Florida roads more deadly than ever for motorcycle riders.

One civil suit settled in Trayvon Martin murder case

The infamous Florida case surrounding the death of Trayvon Martin has reached a small conclusion, with the boy's family settling a wrongful death suit that named the homeowners' association of the subdivision where the boy died as defendants. Martin was killed just feet away from his father's house in February 2012. Reports out of Orlando show that the family has agreed to accept a set amount of money from the community group.

The case garnered national media attention after area police departments wavered about their decision to charge the neighborhood watchman who reportedly gunned down the victim. The watchman, George Zimmerman, was charged with second degree murder. His trial is still pending. Zimmerman contends he shot the youngster only after he was attacked first, according to news reports.

Wrong-way driver kills four on I-95

Four passengers were killed in a fatal car accident along I-95 near Miami on April 3. The cause of the crash: A police chase initiated by a 25-year--old driver who was seen throwing a weapon from his SUV. The suspect turned onto a ramp for I-95 South, even though he was heading north through the Miami area. The resulting head-on collision with a minivan killed all four people inside.

Authorities reported that the grisly crash caused one passenger to be ejected from the vehicle, while two of the others were stuck inside the vehicle. A fourth victim was transported separately. All were pronounced dead at the scene. The identities of the victims were not yet released to the public.

Authorities investigate Florida sky diving accident

Two men are dead following a sky diving accident in Florida in which their parachutes reportedly failed to open, according to the company that oversaw the jumps. Police have yet to confirm parachute failure as the cause of the deaths, however, and are currently awaiting the results of autopsies. Investigators will also likely examine footage from the divers' helmet-mounted camera to learn more about what may have prompted the fatal accident.

The two victims were foreign sky divers visiting Florida on vacation. Unlike car or motorcycle accidents, where usually a driver is at fault, sky divers are typically considered liable for any accidents that occur while jumping, meaning that victims should have been required to sign waivers purging the sky diving facility from liability. While they would not be entitled to liability insurance coverage, the victims' families could potentially seek damages from the facility, the manufacturer of the faulty parachutes or another party with a wrongful death lawsuit.

Florida woman wins $75K in premises liability suit

Tampa will pay $75,000 in damages to a 54-year-old Florida woman who suffered serious injuries from a falling tree limb after the City Council unanimously voted to approve the settlement. The plaintiff argued that Tampa failed to properly monitor and maintain the tree, which was located on city property, causing it to become "rotted and hazardous." The tree has since been removed.

According to the 2010 premises liability lawsuit, the woman was struck by the large branch as she walked down a Tampa street. She was hospitalized with injuries at a local medical center and released later that day. Despite the short length of her hospital stay, the lawsuit asserts that the woman sustained permanent injuries that will likely leave her handicapped in the future. The mayor of Tampa said that while he was unfamiliar with the details of the case, it is the city's duty to properly maintain potentially dangerous trees near city right of ways.

Florida crash kills visiting college students

Two women visiting from out-of-state are dead following an auto accident in the Florida Panhandle. Authorities say that at least seven other people, including the victims' two friends, were injured in the two-vehicle crash, which happened shortly after 11 a.m. Police say the victims and their two friends, all females, were college students returning home after spending their spring break in the state. It is unclear whether any individuals involved in the wreck will face criminal charges or civil lawsuits. Investigators say they have ruled out alcohol as a potential factor in the crash.

Troopers from the Florida Highway Patrol say the serious car accident occurred when one of the victims lost control of her vehicle for an unknown reason, causing it to drift across the center lane and into oncoming traffic. The woman then reportedly jerked the car back into the proper lane, over-correcting and causing the vehicle to spin out and enter the path of a nearby pickup truck. The two vehicles then violently collided, killing the two 21-year-old students. The FHP reports that both women were wearing seat belts at the time of the crash.

Florida family hits Lake County sheriff with wrongful death claim

The family and girlfriend of a Florida man who was fatally shot by a sheriff's deputy in Lake County is demanding $75,000 in damages, according to a recently-filed federal lawsuit. The plaintiffs' wrongful death lawsuit accuses the deputy of contributing to the victim's death by failing to announce himself when he knocked on the man's door. According to the lawsuit, this policy "departs from the appropriate standard of care" and thus makes the deputy and Lake County sheriff liable for the victim's death.

According to the lawsuit, the deputy arrived at the suspect's apartment on an early July morning, wrongfully believing it was home to a suspect in a battery case. The deputy then beat on the victim's door "in such a manner to bewilder or frighten" the man, failing to announce himself as a law enforcement officer. The victim reportedly opened the door with a firearm in his hand, prompting the deputy to fire his own gun six times and hit the man with four bullets.
