Injuries to Children
Injuries to children are especially tragic, particularly when a child is killed or suffers a debilitating injury.
On the first day of school, a young child attending school in Marion County was dropped off at the wrong bus stop. The child had to cross a busy street to get home, but never made it home safely. The child was struck by an oncoming car and was killed. As a result of this horrible incident, our firm was instrumental in forever changing the busing policies and procedures in Marion County. As a result of the Taylor v. Marion School Board case, there is a procedure in place so that children are let off at the correct bus stop so that tragic incidents like this don't happen again.
Cases involving injuries to children are handled differently from a typical personal injury claim. Claims for injuries to children must be brought by the child's natural guardian or by a court-appointed guardian. Any recovery is placed in a protected guardianship account and money may only be withdrawn by court order.
